The Centre of Policy and Legal Reform has prepared its weekly expert analysis of the most important processes in Ukraine in areas of constitutionalism, political parties and elections, governance and public administration reform, judiciary, combatting corruption, criminal justice, etc.

Draft law on the development of the probation system should be returned to the subject of legislative law initiatives for revision

On April 12, the Verkhovna Rada registered (№5360) the draft Law “On Amendments to the Criminal Code of Ukraine, the Criminal Procedure Code of Ukraine on the Development of the Probation System, Increasing Alternatives to Imprisonment and Creating Conditions for Reducing Recidivism” (hereinafter – the draft law). It provides, in particular:
– to transform arrest into a special type of punishment that can be applied only to servicemen;
– to supplement the list of punishments with such type as probation supervision, which can be used both as the main and as an additional punishment;
– to transfer to the authorised bodies on probation part of the powers of the court to determine the restrictions on persons released from probation or parole.
